However, due to the passage of Illinois HB 2231 in 2023, rideshare companies will no longer be exempt from “common carrier” standards as of January 1, 2024. This would mean that Uber and Lyft could be held directly responsible for damages suffered by their passengers, which includes damages from incidents other than car accidents—for example, physical or sexual assault by a rideshare driver.

How Much Insurance Coverage Is Available?

Rideshare companies are required to provide a minimum amount of liability insurance to cover accidents caused by their rideshare drivers. However, the amount of insurance coverage in effect depends on the situation:

  • The Uber or Lyft driver is not working. If the app is closed and the rideshare driver isn’t looking to pick up or transport any fares, then only the rideshare driver’s personal auto insurance applies. In Illinois, drivers are required to carry a minimum of $25,000 per injury and $50,000 per accident on their personal automobiles.
  • The Uber or Lyft driver has the app open, but hasn’t accepted a ride request. The rideshare company must provide $50,000 per person and $100,000 per accident in injury liability coverage.
  • The Uber or Lyft driver has accepted a ride request. If the rideshare driver is on the way to pick up a ride request, or transporting them to their destination, a $1 million bodily injury policy applies.

In some cases, additional sources of insurance coverage might apply—for example, underinsured motorist coverage from your own auto insurance policy.
